1. Introduction

Orndorff Mowen PLLC (“Orndorff Mowen,” “the Firm,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy describes the information we collect through our website, om-pllc.com (the “Site”), how we collect it, how we use and share it, and the choices available to you.

This Policy applies only to information collected through the Site. It does not apply to information we collect offline or in the course of providing legal services, which is governed by our professional obligations, including the rules of professional conduct and attorney-client privilege where applicable.

By using the Site, or by providing consent through our cookie banner, you acknowledge this Policy and consent to the collection and use of information as described below, including the use of the tracking technologies described in Section 4. If you do not agree, please adjust your cookie preferences or discontinue use of the Site.

2. Information You Provide to Us

We collect information you voluntarily provide when you:

  • Submit a contact or “Get Help Now” form (name, email address, phone number, and the contents of your message);
  • Call, email, or fax us using the contact information listed on the Site;
  • Otherwise communicate with us through the Site.

Important: Submitting information through the Site does not create an attorney-client relationship with Orndorff Mowen PLLC. Please do not send confidential or time-sensitive information through the Site’s contact forms until an attorney-client relationship has been established in writing.

3. Information Collected Automatically

When you visit the Site, we and our service providers may automatically collect certain information about your device and your interaction with the Site, including:

  • Internet Protocol (IP) address and approximate geographic location;
  • Browser type and version, operating system, and device type;
  • The pages you view, the date and time of your visit, the length of time spent on pages, and the website that referred you to us;
  • Information about how you interact with pages, such as clicks, scrolling, and mouse movements, and information you type into forms on the Site;
  • If you call a telephone number displayed on the Site, call-related data such as your phone number, the source that led you to the number, and, where permitted and disclosed, call recordings.

We and our third-party service providers use cookies, pixels, tags, scripts, and similar technologies (collectively, “Tracking Technologies”) on the Site. These may include:

  • Essential technologies that are necessary for the Site to function, such as those supporting security and form submission;
  • Analytics services (such as Google Analytics) that help us understand how visitors use the Site, including which pages are visited and how visitors arrived at the Site;
  • Advertising and remarketing technologies (such as pixels from Google or Meta) that may be used to measure the effectiveness of our advertising and to display our ads to people who have visited the Site;

Their collection and use of information is governed by their own privacy policies.

5. Your Consent to Tracking Technologies

When you first visit the Site, we present a cookie consent banner that describes our use of Tracking Technologies and allows you to accept or decline non-essential technologies. Non-essential Tracking Technologies, including analytics, advertising, and session-analytics tools, are deployed only in accordance with your selection.

By clicking “Accept” on the banner, you expressly consent to our use, and our service providers’ use, of the Tracking Technologies described in Section 4, including technologies that may record your interactions with the Site and technologies that may capture identifiers such as your IP address and route information about your visit to third parties.

You may withdraw or change your consent at any time through the “Cookie Settings” link on the Site or by adjusting your browser settings as described in Section 8. Withdrawing consent does not affect the lawfulness of collection that occurred before withdrawal.

6. How We Use Information

We use the information described above to:

  • Respond to your inquiries and communicate with you;
  • Evaluate potential engagements and perform conflict-of-interest checks;
  • Operate, maintain, secure, and improve the Site;
  • Analyze Site usage and measure the effectiveness of our marketing;
  • Market our services, including through remarketing advertising, where permitted;

7. How We Share Information

We do not sell your personal information, and we do not share it with third parties for their own independent marketing purposes. We may share information:

  • With service providers who perform services on our behalf, such as website hosting, form processing, analytics, advertising measurement, call tracking, and IT support, and who are permitted to use the information only to provide those services;
  • For legal reasons, such as to comply with a subpoena, court order, or other legal process, or to protect the rights, property, or safety of the Firm, our clients, or others;
  • In a business transition, such as a merger, reorganization, or sale of the Firm’s assets, subject to professional responsibility obligations.

As noted in Section 4, third-party providers of Tracking Technologies may also collect information directly from your device when you visit the Site, subject to your consent choices.

8. Your Choices

  • Cookie Settings. Use the cookie banner or the “Cookie Settings” link on the Site to accept, decline, or change your preferences for non-essential Tracking Technologies at any time.

Browser Controls. Most browsers allow you to block or delete cookies through their settings. Blocking some cookies may affect Site functionality.

Analytics Opt-Out. You can opt out of Google Analytics by installing the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptout.

Interest-Based Advertising. To learn about interest-based advertising and your opt-out choices, visit www.aboutads.info/choices or www.networkadvertising.org/choices.

Global Privacy Control and Do Not Track. Where required by applicable law, we honor browser-based opt-out preference signals such as Global Privacy Control (GPC) as a request to opt out of targeted advertising. The Site does not otherwise respond to “Do Not Track” signals, for which no uniform standard has been adopted.

9. State Privacy Rights

Depending on where you live, state law may give you rights regarding your personal information, such as the right to know what personal information we have collected about you, the right to access or obtain a copy of it, the right to correct inaccuracies, the right to request deletion, and the right to opt out of targeted advertising. These laws generally apply only to businesses that meet certain thresholds, which the Firm may not meet; however, we will make reasonable efforts to honor requests regardless.

Please note that information protected by the attorney-client privilege or attorney work-product doctrine, or that we are required to retain under professional responsibility rules, may be exempt from certain requests.

10. Data Retention

We retain personal information collected through the Site for as long as reasonably necessary to fulfill the purposes described in this Policy, to comply with our legal and professional obligations, to resolve disputes, and to enforce our agreements. Retention periods vary depending on the nature of the information and the context in which it was collected.

11. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

12. Children’s Privacy

The Site is not directed to children under the age of 18, and we do not knowingly collect personal information from children. If you believe a child has provided us personal information through the Site, please contact us so we can delete it.

13. Third-Party Websites

The Site contains links to third-party websites, including our LinkedIn page and attorney-rating services. This Policy does not apply to those websites, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any website you visit.

14. Changes to This Policy

We may update this Policy from time to time. When we do, we will revise the effective date at the top of this page and, for material changes, provide additional notice on the Site. Your continued use of the Site after changes become effective constitutes acceptance of the revised Policy.
